Website Terms of Service

These Website Terms of Service (“Terms”) govern your use of apprehensivepatientdentalcare.com (the “Website”), operated by APPREHENSIVE PATIENT DENTAL OFFICES, P.C. (the “Practice,” “we,” “us,” or “our”), located at 37 Highway 35, Suite 6, Eatontown, New Jersey 07724. By using the Website, submitting a form, requesting an appointment, or opting in to text messages, you agree to these Terms. If you do not agree, please do not use the Website.

Name used on the Website. The Website appears under the domain apprehensivepatientdentalcare.com and may refer to the Practice as “Apprehensive Patient” or “Apprehensive Patient of Eatontown.” The Website and these Terms cover only the Practice’s office at 37 Highway 35, Suite 6, Eatontown, New Jersey 07724. Other dental offices that use the name “Apprehensive Patient” are separately owned and operated, and the Practice is not responsible for their services, websites or communications.

1. Informational Purpose Only

Content on the Website, including descriptions of services, sedation options, treatment information and blog posts, is general information. It is not dental or medical advice and is not a substitute for an examination, diagnosis or treatment plan from a licensed dentist. Treatment outcomes vary from patient to patient, and no result described on the Website is guaranteed.

2. No Dentist and Patient Relationship

Using the Website, submitting a form, or exchanging emails or texts with us does not create a dentist and patient relationship. That relationship begins only when you are accepted as a patient, complete our intake paperwork, and are seen by one of our dentists.

3. Emergencies

Do not use Website forms, email or text messages for urgent needs. If you have a dental emergency during office hours, call us at (732) 544-9101. If you have facial swelling that affects breathing or swallowing, uncontrolled bleeding, or any other medical emergency, call 911 or go to the nearest emergency room.

4. Eligibility

You must be at least 18 years old to use the Website’s forms or opt in to text messages. A parent or legal guardian must submit information on behalf of anyone under 18.

5. Appointment Requests

Submitting an appointment request does not confirm an appointment. An appointment is confirmed only when our office or our scheduling provider confirms it with you. We may decline, reschedule or cancel requests based on provider availability, emergencies, incomplete information or other reasonable considerations. Office policies on cancellations, missed appointments, payment and insurance are provided separately at intake and are not part of these Terms.

6. Insurance, Pricing and Financing Information

References on the Website to accepted insurance plans, fees, promotions or financing are general and may change without notice. Your actual coverage depends on your plan, and your costs will be confirmed by our office before treatment. Financing, including through CareCredit, Cherry and LendingClub, is offered by independent third parties. They, not the Practice, make all credit decisions and set their own terms.

Our In-House Membership Plan is offered directly by the Practice. It is not dental insurance, does not replace insurance, and is not accepted at other dental offices, including other offices that use the name Apprehensive Patient. Pricing, covered services and discounts are listed on the Website and in the plan terms you receive at enrollment; if they differ, the enrollment terms control.

7. Sensitive Information and Electronic Communications

Please do not send detailed health history, insurance member numbers, Social Security numbers or payment card details through general Website forms, standard email or text messages. These channels may not be secure. Call our office for anything sensitive. Health information you provide as a patient is protected under our HIPAA Notice of Privacy Practices, available through the link in the Website footer and at our front desk.

8. Text Messaging Program

If you opt in by checking the text message consent box on one of our forms or by otherwise agreeing in writing, you agree to receive recurring automated and conversational text messages from APPREHENSIVE PATIENT DENTAL OFFICES, P.C. at the mobile number you provide. Messages may include appointment reminders and confirmations, rescheduling notices, post-treatment follow-up, billing reminders and, only if you separately opt in to them, promotional offers.

  • Consent is not a condition of purchase or of receiving dental care.
  • Message frequency varies with your appointments and interactions with us.
  • Message and data rates may apply.
  • Reply STOP at any time to cancel. You will receive one final message confirming you are unsubscribed.
  • Reply HELP for help, or call (732) 544-9101 or email contact@apprehensivepatientdentalcare.com.
  • Carriers are not liable for delayed or undelivered messages.
  • Mobile opt-in data and consent are not shared with third parties or affiliates for their marketing or promotional purposes.

You agree to enroll only a mobile number that you own or are authorized to use. Our messaging is delivered through Adit, our patient communication platform. See our Privacy Policy for how text message data is handled.

9. Acceptable Use

You agree not to submit false or misleading information, submit information about another person without authority, upload malicious code, attempt to gain unauthorized access to the Website or connected systems, scrape or copy the Website by automated means, or use the Website for any unlawful purpose.

10. Intellectual Property

Text, photographs, graphics, logos, videos and design on the Website are owned by or licensed to the Practice and are protected by copyright and trademark law. You may view and print pages for personal, noncommercial use. Any other use requires our prior written permission.

11. Reviews and Testimonials

Patient testimonials and reviews shown on the Website reflect individual experiences and are not a promise of similar results. Where a reviewer has received any incentive, we will disclose it.

12. Third-Party Services and Links

The Website may use or link to services operated by others, such as online scheduling, form tools, maps, embedded video, review widgets and financing applications. Those services have their own terms and privacy policies. We do not control them and are not responsible for their content, availability or practices.

13. Disclaimer of Warranties

The Website is provided “as is” and “as available.” We work to keep it accurate and available, but we do not warrant that it will be uninterrupted, error free or free of harmful components, or that all content is complete or current. These disclaimers relate to the Website only. They do not limit any duty of care we owe you as a patient, and they apply in New Jersey only to the extent permitted by New Jersey law.

14. Limitation of Liability

To the extent permitted by New Jersey law, the Practice and its owners, dentists and staff are not liable for indirect, incidental or consequential damages arising from your use of the Website, including delayed or undelivered messages, technical interruptions, or your use of third-party services. This section relates to the Website only. It does not limit liability for dental care you receive, for our negligence or intentional misconduct, or for anything else that New Jersey law does not allow to be limited.

15. Indemnification

You agree to reimburse the Practice for reasonable losses, including attorneys’ fees, that result from your violation of these Terms or your misuse of the Website, to the extent permitted by New Jersey law.

16. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Website will be brought in the Superior Court of New Jersey, Monmouth County, or the United States District Court for the District of New Jersey, and you consent to the jurisdiction of those courts.

17. Accessibility

18. Changes to These Terms

We may update these Terms by posting a revised version with a new Effective Date. Changes apply from that date forward.

19. General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Website.
